Important Legal Notice & Disclaimer
PLEASE READ THIS AGREEMENT CAREFULLY. BY CLICKING "I AGREE AND AUTHORIZE" OR BY USING FIDEPACT.COM, YOU ACKNOWLEDGE AND AGREE THAT:
FIDEPACT IS A TECHNICAL CUSTODY SERVICE AND DOES NOT PROVIDE LEGAL, FINANCIAL, OR TAX ADVICE. THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. FIDEPACT IS NOT A LAW FIRM AND DOES NOT SUBSTITUTE THE ADVICE OF A QUALIFIED LEGAL PROFESSIONAL.
WE DO NOT GUARANTEE THE LEGAL ENFORCEABILITY OF YOUR ELECTRONIC RECORD OR SECURE ELECTRONIC RECORD AS A WILL OR TESTAMENT IN ANY SPECIFIC JURISDICTION.
1. Acceptance of Terms
By initializing a protocol on FidePact, you agree to be bound by these Terms of Service. This is a legally binding agreement between you and FidePact regarding your use of our zero-knowledge digital heritage protocol.
2. Zero-Knowledge Fiduciary Relationship
FidePact operates as a "Blind Fiduciary." We provide the mathematical infrastructure for asset preservation but possess no ability to access, view, or recover your Secure Electronic Record.
2.1 Zero-Knowledge Nature: FidePact operates as a "Blind Fiduciary." We do not store, view, or possess the ability to reset your Master Key or decrypt your Secure Electronic Record.
2.2 Self-Custody: You are solely responsible for your Master Key. If you lose this key, your Secure Electronic Record becomes mathematically unrecoverable.
2.3 Management Access (Three-Factor): To manage, update, or cancel your protocol, you must retain (i) your Master Key, (ii) the system-generated Protocol ID, and (iii) the Beneficiary Email. Loss of Protocol ID or the Beneficiary Email results in a permanent loss of administrative control.
2.4 Master Key Transfer Responsibility: FidePact does not facilitate the transmission of the Master Key to your beneficiaries. It is your absolute responsibility to share it with your beneficiary via secure offline channels.
3. User Responsibility & Bearer Risk
The Master Key is generated locally on your device to create a Secure Electronic Record. FidePact does not store, transmit, or back up this key. Loss of the Master Key results in permanent, irreversible loss of access to the stored Secure Electronic Record. FidePact shall not be held liable for any loss arising from the user's failure to secure the Master Key.
Security Alert: Bearer Credential Status
Your Protocol ID, Beneficiary Email, and Master Key function as Bearer Credentials. If these are compromised, an unauthorized party can reset the Pulse timer, potentially preventing your Secure Electronic Record from ever being released. FidePact cannot distinguish between authorized and unauthorized resets. You assume 100% liability for any losses or non-delivery resulting from the disclosure of these credentials to third parties.
4. Protocol ID & Data Sovereignty
Your Protocol ID is your public identifier, required to manage your Pulse settings. You must maintain the strict confidentiality of your Protocol ID. Unauthorized disclosure to a third party creates a risk of malicious suppression; an unauthorized party could use your Protocol ID at fidepact.com/pulse to perpetually reset the Pulse timer, effectively preventing your Secure Electronic Record from ever being released. You maintain full sovereignty over your **Secure Electronic Record** only insofar as you secure these identifiers.
5. Pulse Monitoring & Automatic Trigger
The "Pulse" is an autonomous monitoring system. Failure to reset the timer (Dispatching a Signal) within the user-defined cycle will be interpreted by the protocol as an "Incapacity Event," triggering the automatic transmission of the Secure Electronic Record to the registered beneficiary.
6. Beneficiary Information
You are solely responsible for ensuring the accuracy of the beneficiary email address. FidePact is not responsible for a **Secure Electronic Record** sent to incorrect, inactive, or compromised email accounts provided by the user.
7. Fees & Payments
Fees for initializing the Genesis Slot are one-time and non-refundable. These fees cover the allocation of secure node storage for your **Secure Electronic Record** and the maintenance of the autonomous monitoring infrastructure.
8. Governing Law & Dispute Resolution
8.1 Governing Law: Singapore (FidePact Pte. Ltd.).
8.2 Mediation: Singapore International Mediation Centre (SIMC).
8.3 Arbitration: Singapore International Arbitration Centre (SIAC).
This agreement is governed by the laws of Singapore. Any dispute arising out of or in connection with this contract shall be referred to and finally resolved by arbitration in Singapore administered by the SIAC in accordance with its Arbitration Rules.
9. Limitation of Liability & Disclaimers
To the maximum extent permitted by applicable law, FidePact shall not be liable for any direct, indirect, incidental, special, or consequential damages. This includes, without limitation, damages for loss of digital assets, your Secure Electronic Record, or inheritance rights arising from any failure of performance, error, omission, interruption, or technical malfunction.
Critical Disclaimer: Credential Compromise & Pulse Reset
FidePact operates as a blind fiduciary and cannot distinguish between authorized and unauthorized access to your protocol. You acknowledge and agree that:
- If your Protocol ID, Beneficiary Email, or Master Key is lost or disclosed, a third party may reset the Pulse timer to prevent the release of your Secure Electronic Record.
- You assume total responsibility for all losses, including the "perpetual suppression" of your **Secure Electronic Record**, resulting from such unauthorized resets.
- FidePact disclaims all liability for acts, omissions, and conduct of any third parties in connection with your use of the site.
Specific Disclaimer on Delivery: FidePact is not responsible for non-delivery or failure of the Protocol caused by: (i) User's loss or compromise of credentials; (ii) Incorrect Beneficiary data; (iii) Emails being blocked or marked as spam/junk; (iv) Any technical failure on the part of the User’s or Beneficiary's provider.
Maximum Liability Cap:
In no event shall FidePact’s total aggregate liability exceed the total amount of fees actually paid by the User to FidePact for the specific protocol instance. Your sole remedy against FidePact for dissatisfaction with the site or any content is to stop using the site.
10. Data Delivery & Recovery Portal
If transmission emails are lost, beneficiaries can manually request access via our Recovery Portal to download the **Secure Electronic Record** using the Protocol ID and the registered Beneficiary Email. The Protocol ID is a bearer-credential; loss of this ID by the User or Beneficiary is the sole responsibility of the User.
11. Prohibited Use & Compliance
Users shall not use the Protocol to store, transmit, or facilitate the distribution of any Electronic Record that is illegal, fraudulent, or in violation of Singapore’s laws, including but not limited to Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) regulations.
11.1 Technical Prohibitions: You may not attempt to gain unauthorized access to any portion of the Site, or any other systems or networks connected to the Site, by hacking, password "mining" or any other illegitimate means. You may not probe, scan or test the vulnerability of the Site or any network connected to the Site.
11.2 Artificial Intelligence Restriction: You may not use automated bots to access, scan, scrape, data mine, copy, or use the materials or content on this website for developing, training, or improving a machine learning model or artificial intelligence (AI) system.
12. Intellectual Property
All text, graphics, user interfaces, visual interfaces (including "breathing lights" and dynamic effects), trademarks, logos, and computer code contained on the Site are owned or controlled by FidePact Pte. Ltd. No part of the Site may be copied, reproduced, mirrored, or reverse-engineered without express prior written consent.
13. Service Availability & Security Disclaimer
The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. FidePact does not warrant that the service will be uninterrupted or error-free. We reserve the right to perform maintenance as necessary to perform routine or non-routine maintenance.
13.1 Security Warranty: FidePact cannot ensure that any Secure Electronic Record or other data you download from the Site will be free of viruses or contamination or destructive features. You assume total responsibility for your use of the Site and any linked sites.
14. Right to Modify Terms
FidePact reserves the right, at its sole discretion, to change or modify portions of these Terms of Use at any time. It is your responsibility to check these Terms periodically for changes. Continued use of the protocol following the posting of changes will mean that you accept and agree to the modifications.
15. Third-Party Services & Links
This Site may contain links to other independent third-party Web sites ("Linked Sites"). Such linked sites are not under FidePact’s control, and FidePact is not responsible for and does not endorse the content of such Linked Sites. We provide hyperlinks for convenience only, and no endorsement of third-party websites or content is implied.
16. Privacy Policy Reference
Your use of the Service is also subject to the FidePact Privacy Policy. By agreeing to these Terms, you acknowledge the collection and use of minimal necessary metadata as described in the Privacy Policy to ensure protocol functionality.
17. Age Restriction
The Service is intended for use only by individuals who are at least 18 years of age or the age of legal majority in their jurisdiction. The Site is not intended for use by minors. By initializing a protocol, you represent and warrant that you have the full legal capacity to enter into this agreement.
18. Severability
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of these Terms.
19. Force Majeure
19.1 Definition: "Force Majeure" means an event or circumstance beyond FidePact's reasonable control that is unforeseeable, unavoidable, and insurmountable, which prevents or delays the performance of any obligations under these Terms.
19.2 Scope of Events: Force Majeure Events shall include, but are not limited to:
- Acts of God, fire, flood, earthquake, or other extreme natural disasters;
- War, hostilities, terrorism, civil unrest, or government sanctions;
- Infrastructure Failure: Large-scale disruption of global telecommunications, power grids, or the catastrophic collapse of global internet infrastructure;
- Technical Force Majeure: Major outages or service terminations of critical third-party infrastructure (specifically Cloudflare Edge Network and Stripe Payment Gateway);
- Security Force Majeure: Hacking, mass-scale cyber-warfare, or distributed denial-of-service (DDoS) attacks that exceed commercially reasonable defense capabilities;
- Cryptographic Collapse: Unforeseen mathematical or quantum computing breakthroughs rendering AES-256 encryption or the integrity of a **Secure Electronic Record** insecure.
19.3 Automatic Suspension: FidePact’s performance is deemed to be automatically suspended for the duration of the Force Majeure Event. FidePact™ shall incur no liability for any loss, data delivery failure, or delay in transmitting a **Secure Electronic Record** arising from such events.
Notice: If the Force Majeure Event continues for a period exceeding 120 days, either party may terminate the protocol upon written notice, and FidePact™ shall be released from all further obligations and liabilities regarding any stored **Secure Electronic Record**.
20. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire and exclusive understanding and agreement between you and FidePact regarding your use of and access to the Site. Any ambiguity in the interpretation of these Terms shall not be construed against FidePact.
21. No Waiver
The failure of FidePact to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in the future.
22. Technical Neutrality & No Trust Relationship
FidePact provides a neutral technical infrastructure for the generation and transmission of a Secure Electronic Record. The initialization of a protocol does not create a formal legal trust, a traditional fiduciary relationship, or an attorney-client relationship under Singapore law.
"FidePact provides an automated protocol for data transmission. We do not review the substance of your Secure Electronic Record for legal validity, nor do we act as legal counsel."
Important Notice: Users are strongly encouraged to consult with a qualified legal practitioner in Singapore regarding the formal enforceability and probate validity of their records.
FidePact assumes no proprietary interest in the Electronic Record stored or transmitted by the User. Our role is strictly limited to the execution of the autonomous monitoring and delivery protocol as configured by the User.
23. Sanctions & AML Compliance
The User represents and warrants that they are not subject to any economic or financial sanctions administered by Singapore, the UN, or other relevant jurisdictions. You shall not use the Protocol to facilitate activities violating international sanction regimes via a Secure Electronic Record.
24. Tax & Regulatory Responsibilities
The User and their Beneficiaries are solely responsible for any tax implications, reporting requirements, or legal duties arising from the transmission or receipt of a Secure Electronic Record through the Protocol. FidePact does not provide tax advice.
25. Statute of Limitations
You agree that any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred.
26. Indemnity
You agree to indemnify and hold FidePact, its officers, directors, shareholders, employees, agents, and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against FidePact by any third party due to or arising out of or in connection with your use of the Site.
27. Operational Logic & Protocol Lifecycle
FidePact operates on a Stateless, Local-First Encryption model. You acknowledge that:
- Local Encryption: The Electronic Record is encrypted within your local browser environment to form a Secure Electronic Record. The FidePact server never store, or transmits your Master Key.
- Protocol Multiplicity: Every submission at fidepact.com/vault generates a unique, independent Protocol ID and a corresponding Secure Electronic Record. If you submit new data without explicitly terminating a previous protocol at fidepact.com/access, multiple independent protocols will run concurrently.
- Access & Control: The Secure Electronic Record download, and protocol termination are conducted exclusively via fidepact.com/access using your Protocol ID and Beneficiary Email.
28. The Dual-Trigger "Pulse" Mechanism
The "Pulse" is an autonomous monitoring task that executes based on the following logic. You are solely responsible for selecting and maintaining your preferred mode for the release of your Secure Electronic Record:

Users in Mode B must manually visit pulse.html to reset the timer. No notifications will be issued for anonymous protocols.
29. Bearer Credentials & Responsibility
Your ability to control and decrypt your Secure Electronic Record rests upon Three Pillars. Loss of any pillar is irreversible:
Protocol ID
Required for Pulse reset and retrieval.
Beneficiary Email
Must be accurate and accessible.
Master Key
Locally generated. Used to decrypt the Secure Electronic Record.
30. Irreversible Loss & Absolute Liability
Critical Disclosure on Decryption:
FidePact operates on a "Bearer-Credential" basis. The Master Key is the sole and indispensable requirement for the decryption of your Secure Electronic Record. FidePact does not possess, store, or facilitate the transmission of the Master Key. You bear the exclusive obligation to securely share the Master Key with your Beneficiary via private, offline channels promptly upon protocol set up.
Permanent Data Oblivion Warning
If the Master Key is lost and never shared with the Beneficiary, the Secure Electronic Record will be PERMANENTLY UNRECOVERABLE, even after a successful Pulse release. By using this service, you agree to the following:
- Inability to Distinguish: FidePact has no technical means to distinguish between an authorized user and an unauthorized third party in possession of your credentials. Any action performed (e.g., Pulse reset, data download, or protocol termination) using valid credentials shall be deemed as authorized by you.

Comprehensive Liability:
You assume 100% liability for all financial, legal, or sentimental losses resulting from:
- Forgetting or misplacing the Protocol ID and Master Key, or failing to communicate credentials to your Beneficiary;
- Unauthorized disclosure, theft, or compromise of credentials due to your negligent storage (e.g., keeping keys in plain text, unencrypted files, or shared environments);
- Phishing, social engineering, or malware attacks on your local devices.
- Non-Recoverability: FidePact possesses no technical means to reset, recover, or "backdoor" any encrypted protocol, stored Secure Electronic Record, or Master Key, regardless of whether the loss was caused by your forgetfulness or a third-party breach of your security.
31. Feedback and Information
Any feedback you provide at this site shall be deemed to be non-confidential. FidePact shall be free to use such information on an unrestricted basis. The information contained in this web site is subject to change without notice.
